There Can Be Concerns When Considering Bankruptcy

Outstanding debt is very stressful. The situation can be too difficult to deal with. It is time to take serious action. The purpose of bankruptcy is not to hold you accountable as in penalizing you for your debts; it was created to ensure that consumers have a way out of debt and the chance for a fresh start as a result of unforeseen circumstances. This does not mean that you will suffer zero losses through your bankruptcy. Depending on your income, your debts, your livelihood and the type of bankruptcy you choose, the court may have to confiscate and sell part of your property to pay your creditors. Fortunately, there are many exceptions that you can use to protect your assets and property.


Chapter 7

The first decision to will make is to decide which bankruptcy chapter is best for you. You’ll conduct the means test that determines whether you have the "means" to pay your debts according to the details of your situation. If you pass the test, you are entitled to Chapter 7, which will eliminate unsecured debts. Most people who file Chapter 7 bankruptcy can keep their assets, as these can be "inactive" cases. If you have secured loans such as a car or a mortgage loan, you can keep the property for as long as you keep the payments and keep the property insured. If these payments are no longer reasonable after reviewing your budget, you can end the loan by returning the property. In some instances, the trustee of the court may decide whether it is advantageous to reimburse the creditor for any remaining value.



Chapter 13

Chapter 13 may be a good choice if you have assets that would be lost in a Chapter 7 (or if you fail the means test). Your debt will be reconfigured and paid to the court for 3-5 years. This is considered a full payment for your secured debt. At the end of your payment period, the remaining unsecured debts are settled. In Chapter 13, you can keep your property while so long as you’re servicing your debts according to your Chapter 13 repayment plan.
