A Bankruptcy Discharge Has Great Power

A bankruptcy discharge is the part of the bankruptcy process where individual debtors are permanently released from all qualifying debts. It is a legal injunction that states the debtor is no longer legally obligated to pay the debts back, ever.

Although the debtor is no longer responsible for repaying the debt, creditors and lenders can legally enforce liens attached to secured debts. Even after the debt has been discharged, creditors can repossess and sell the property secured to a lien.

For most people filing bankruptcy, the bankruptcy discharge is one of the most important steps in the process. It allows the debtor to have a clean slate, wiping away debt such as credit cards, medical debt, and personal loans. Corporations and other partnerships are not eligible for bankruptcy discharge.

Which Debts Are Discharged?

Not all debts can be discharged. Certain types of debt have been deemed not dischargeable by Congress as they conflict with public policy. Some common types of debt that cannot be discharged are tax debts, spousal or child support, alimony, mortgages or association fees, fines to be paid to the government, and debts due to personal injury caused by the debtor being under the influence while driving. Student loan debt is nearly impossible to get discharged.


How Does A Bankruptcy Discharge Affect A Credit Report?

Bankruptcy discharge stays on an individual’s credit report for a specific length of time, depending on the type of case. The impact of bankruptcy on a credit report lessens as time goes by and the debtor rebuilds their credit. In a Chapter 7 case, the bankruptcy remains on the credit report for ten years. In a Chapter 13 case, the bankruptcy remains on the credit report for seven.



When Does A Bankruptcy Discharge Occur?

Bankruptcy discharge occurs at the end of a bankruptcy case, though the specific time frame depends on the case. In a Chapter 7 case, the discharge occurs approximately four months after the filing. In a Chapter 13 case, the discharge occurs once all repayments have been made, typically in about three to five years. Most of the time, debtors are required to take a course on financial responsibility and management before their bankruptcy discharge is finalized.
